Skagit County Commissioners remand the permit process back to the Hearing Examiner

On October 6th, the Board of County Commissioners reversed a permit to expand the Lake Erie gravel pit, ruling yet again that the applicant must study the mine’s potential to cause landsliding in the Sunset Lane neighborhood. In February 2021, the Commissioners issued the same order after finding that Evergreen Islands’ expert consultant, Dan McShane, had shown that groundwater from the site would flow to unstable coastal bluffs underlying that neighborhood northwest of the mine. The applicant’s groundwater study had overlooked that possibility. Rather than study that risk, however, the applicant hired a new consultant who relied on the same inapposite study. Fortunately, the Commissioners realized that no new study had occurred, and sided with Evergreen Islands in remanding the permit yet again for a physical investigation into the landslide risk.
